Welcome to SIHOO! These Terms & Conditions ("Agreement" or "Terms") is a contract between you and Shenzhen Sihoo Intelligent Home Co., Limited. (Zhancheng Community, Fuhai Street, Bao'an District Room 501, Building A, Haoyuan Industrial Park, No. 94, Fuyuan 1st RoadShenzhen Guangdong 518103) ("SIHOO," "we," "us," or "our"), governing your access to and use of our website at https://de.sihoooffice.com (the "Site"), as well as any other websites, pages, features, or content owned and operated by us that hyperlink to this Agreement (collectively, the "Services").

By using our Site or making a purchase through our sales team in the European Union, you agree to be bound by these Terms, which include important information regarding your rights and obligations, as well as conditions, limitations, and exclusions that may apply to you.

1. Copyright and Trademarks

2. Order Terms

Purchase of Products: You may purchase products through our online store at https://de.sihoooffice.com or via a SIHOO sales representative. Product descriptions are provided for convenience, and accuracy is not guaranteed. Your sole remedy for a product that does not match its description is to return the item as outlined in our return policy.

Payments: You authorize us (or our third-party payment processor) to charge you for the transaction. You must provide accurate payment details and ensure you have sufficient funds. All transactions will be settled in Euros (€). SIHOO is not responsible for online payment processing issues or fees charged by your card issuer.

Order Acceptance: Receipt of an order confirmation does not mean we have accepted your order. SIHOO may accept or decline orders at our discretion.

Order Cancellation: To cancel an order, contact us within 1 hour of placing the order and before 12:00 PM Central European Time. If the order has not yet shipped, we will issue a full refund. Orders cannot be canceled after 1 hour and must be returned through our Return Merchandise Authorization (RMA) process. Shipping costs for returned items will be deducted from your refund.

Prices and Promotions: Prices are displayed in Euros and are subject to change. Promotions are governed by their own terms, which take precedence over these Terms if there is a conflict.

Shipping: Products will be shipped to the address provided during checkout. Title and risk of loss pass to you when the products are handed over to our shipping partner.

Returns: We offer a 30-day hassle-free return and replacement policy from the date you receive your item(s). Returns are subject to SIHOO's return policy available on our website.

Third-Party Products: Products from third parties are sold at your own risk. SIHOO assumes no responsibility for these products.

Goods Not for Resale or Export: You agree to use the products for personal or household purposes only and not for resale or export.

3. Linking Terms

Linked Sites: SIHOO does not guarantee the content or functionality of websites linked from https://de.sihoooffice.com or those linking to our site. Responsibility for linked sites rests with their respective operators.

Linking to Us: If you wish to link to https://de.sihoooffice.com from another website, you must obtain prior permission from us. Requests should be sent via our contact us. Any link should direct to our homepage and clearly indicate that it is a link to our site.

4. Dispute Resolution

Informal Resolution: If a dispute arises, you agree to notify us in writing at the email address below at least 30 days before initiating any legal proceedings to attempt an informal resolution.

Mandatory Arbitration (Business-to-Business): For disputes between SIHOO and a business entity (not consumers), any controversy arising out of or relating to these Terms shall be finally settled by arbitration administered in Madrid, Spain. Consumers always have the right to bring proceedings in their home country courts.

Class Action Waiver (Businesses only): As a business entity, you may only bring claims in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding. This waiver does not apply to consumers.

5. User-Generated Content

Definition and Scope: As a user of SIHOO's services, you may post, upload, and contribute content, including but not limited to text, images, messages, and other types of content ("User Content"). This User Content includes anything posted on the SIHOO platform or associated services.

Your Promises: By posting User Content, you affirm that:

  • Right to Post: You have the necessary rights and permissions to post the User Content.
  • Compliance: Your User Content and its use by SIHOO does not violate any agreements, applicable laws, or the intellectual property, publicity, personality, or other rights of others.

SIHOO's Rights: SIHOO may monitor, review, or edit User Content but is not obligated to do so. SIHOO reserves the right to remove or disable access to any User Content at its sole discretion, without prior notice, especially if it violates this Agreement or applicable laws.

Responsibility: You are solely responsible for any User Content you post. SIHOO does not endorse any User Content and is not liable for any claims arising from User Content you provide. You agree to indemnify and hold SIHOO harmless from any claims, damages, losses, or expenses related to your User Content.

6. Content Ownership and Rights

Ownership: SIHOO does not claim ownership of your User Content. However, by posting User Content, you grant SIHOO a non-exclusive, worldwide, royalty-free license to use, copy, modify, create derivative works, distribute, publicly display, and perform your User Content for the operation and promotion of SIHOO services. This license continues even after you stop using our services.

Intellectual Property: SIHOO owns all rights, titles, and interests in and to its services and content, including all associated intellectual property rights. This includes trademarks, service marks, and logos ("SIHOO Trademarks"), which cannot be used without prior written consent. All goodwill generated from the use of SIHOO Trademarks benefits SIHOO.

Limited License to Users: SIHOO grants you a limited, non-exclusive, non-transferable license to access and view the content provided by SIHOO for your personal, non-commercial use, subject to your compliance with this Agreement.

7. User Responsibilities and Data Protection

Content Accuracy and Lawfulness: You are responsible for ensuring that your User Content is accurate, complete, and complies with all applicable laws. You represent that your User Content does not infringe on the rights of any third party, including intellectual property rights, and does not violate any laws or contractual obligations.
